TERMS & CONDITIONS
(“User Agreement”)

These Terms & Conditions (“Terms”) constitute a binding legal contract between JAGCART MEDIA (“JAGCART”, “we”, “us” or “our”)—a sole-proprietorship concern registered under the Maharashtra Shops & Establishments Act, having its principal place of business at 301-C, 3^rd Floor, Harmony Tower, Netaji Subhash Road, Court Naka, Thane (W) Maharashtra 400 602, India
—and any natural or juridical person (“User”, “you” or “your”) who accesses or uses the website www.yantrasource.com^TM (including any sub-domain, mobile site or application) (“Site”).

By visiting, browsing, registering with, or transacting on the Site, you acknowledge that you have read, understood and agreed to be bound by these Terms, the Privacy Policy, Cookie Notice, and any other policies or disclosures linked herein (collectively, “Policies”). If you do not agree to be bound, you must immediately discontinue use of the Site.

2 | Eligibility

2.1 Use of the Site is permitted only to (a) individuals who are at least 18 years old and otherwise competent to contract under the Indian Contract Act 1872, or (b) duly constituted entities represented by an individual authorised to bind such entity.
2.2  JAGCART MEDIA may, in its sole discretion, refuse access to or suspend any Account that does not satisfy the above criteria.

3 | Account Registration & Security

3.1 To access certain features (e.g., placing orders, posting reviews) you must create an Account and provide accurate, current and complete information.
3.2 You are solely responsible for safeguarding your credentials and for all activities that occur under your Account. Notify us immediately publisher@themachiningworld.com of any unauthorised use.
3.3  JAGCART MEDIA shall not be liable for any loss or damage arising from your failure to maintain confidentiality of credentials.

4 | Role of JAGCART MEDIA

4.1 For listings uploaded by third-party Sellers, JAGCART MEDIA acts only as an “online marketplace/intermediary” within the meaning of s. 2(w) of the Information Technology Act 2000 and Rule 3 of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021.
4.2 Unless expressly stated otherwise, the contract for sale is directly between Buyer and Seller; JAGCART MEDIA is neither buyer nor agent of buyer.
4.3  JAGCART MEDIA does not (a) endorse any Seller, (b) guarantee quality, suitability, legality or safety of Products, or (c) assume responsibility for Seller defaults, except where JAGCART MEDIA itself is the Seller of record.

5 | Product Listings, Pricing & Availability

5.1 Descriptions, specifications, images and prices are provided by Sellers or sourced from public materials. While reasonable care is taken, JAGCART MEDIA does not warrant that any information is accurate, complete or error-free.
5.2 Prices are displayed in Indian Rupees (INR) unless stated otherwise and are inclusive/exclusive of taxes as indicated.
5.3 Availability may change without notice. JAGCART MEDIA or the Seller may cancel an order prior to dispatch if the Product is unavailable, subject to a full refund.

6 | Orders, Payments & Taxes

6.1 By placing an order, you authorise JAGCART MEDIA or its payment partners to debit the total order value (inclusive of taxes, delivery and fees) from your selected payment method.
6.2 Supported payment channels (card, UPI, net-banking, wallets, NEFT/RTGS) are processed in accordance with RBI regulations and your issuer’s terms.
6.3 Invoices, e-way bills and GST compliance are the Seller’s responsibility; GST input credit eligibility depends on the GSTIN you furnish.
6.4 JAGCART MEDIA may decline or cancel orders that appear fraudulent, violate these Terms, or arise from obvious errors.

7 | Shipping, Delivery & Risk of Loss

7.1 Delivery timelines displayed on the Site are estimates. Title and risk of loss pass to the Buyer upon hand-over to the carrier, unless otherwise agreed in writing.
7.2 Inspect deliveries on receipt and report shortages or damage to the Seller/JAGCART MEDIA within 48 hours.

8 | Cancellations, Returns & Refunds

8.1 Return eligibility, restocking charges and refund timelines vary by Product category and Seller policy, subject to the Consumer Protection (E-Commerce) Rules 2020 and manufacturer warranties.
8.2 To initiate a cancellation or return, follow the Site workflow or e-mail publisher@themachiningworld.com
8.3 Approved refunds will be processed to the original payment method within 7–10 working days, subject to banking timelines.

9 | User Content & Conduct

9.1 You may post reviews, queries or other content (“User Content”) provided it is lawful, accurate and non-infringing.
9.2 You grant JAGCART MEDIA a perpetual, worldwide, royalty-free licence to use, reproduce, modify, adapt, publish, translate and distribute such User Content in any media.
9.3 You agree not to:
 (a) upload content that is defamatory, obscene, hateful, harassing or otherwise prohibited by law;
 (b) misrepresent your identity or affiliation;
 (c) interfere with or damage the Site;
 (d) harvest or scrape Site data;
 (e) circumvent any security or fee mechanism.

10 | Intellectual Property

10.1 All text, graphics, interfaces, photographs, trademarks, logos, software and other material on the Site (“Content”) is owned by or licensed to JAGCART MEDIA and protected by Indian IP laws.
10.2 Except as expressly permitted, you may not reproduce, distribute, publicly display, or create derivative works of any Content. A limited, revocable, non-exclusive licence is granted to access and use the Site for personal or internal business purposes only.

11 | Privacy & Data Protection

11.1 Our collection and use of personal data is governed by the YantraSource^TM Privacy Policy, which is incorporated by reference.
11.2 By using the Site, you consent to our processing of your data in accordance with the Digital Personal Data Protection Act 2023 and allied rules.

12 | Disclaimer of Warranties

12.1 The Site, Content, Marketplace services and all Products are provided “as is” and “as available” without warranty of any kind, express or implied.
12.2  JAGCART MEDIA disclaims all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
12.3 No advice or information obtained by you from JAGCART MEDIA shall create any warranty not expressly stated herein.

13 | Limitation of Liability

13.1 To the fullest extent permitted by law, JAGCART MEDIA shall not be liable for indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or other intangible losses arising out of or relating to (a) your use of or inability to use the Site; (b) any Products; or (c) any conduct or content of third parties.
13.2 In any event, JAGCART MEDIA’s aggregate liability shall not exceed ₹ 10,000 or the amount paid by you for the disputed transaction—whichever is higher.

14 | Indemnification

You agree to indemnify and hold harmless JAGCART MEDIA, its proprietor, employees and agents from any claims, damages, losses and expenses (including reasonable legal fees) arising from (a) your breach of these Terms; (b) your violation of law or third-party rights; or (c) your User Content.

15 | Termination & Suspension

15.1 JAGCART MEDIA may suspend or terminate your Account or access to the Site, with or without notice, for any breach of these Terms or applicable law.
15.2 Upon termination, all rights granted to you herein shall cease and you must delete all downloaded Content.

16 | Governing Law & Dispute Resolution

16.1 These Terms shall be governed by, and construed in accordance with, the laws of India.
16.2 Subject to consumer-redressal forums available under the Consumer Protection Act 2019, the courts at THANE , Maharashtra shall have exclusive jurisdiction over any disputes.
16.3 Nothing herein restricts either party’s right to seek injunctive or equitable relief in any competent court.

17 | Grievance (IT Rules & E-commerce Rules)

Our Appointed Grievance Officer will acknowledge complaints within 48 hours and endeavour to resolve them within one (1) month as required by law.

18 | Modifications

JAGCART reserves the right to modify these Terms at any time. Material changes will be posted with an updated “Effective” date and, where legally required, notified to you by e-mail. Continued use of the Site after the effective date constitutes acceptance of the revised Terms.

19 | Miscellaneous

19.1 Force Majeure: JAGCART shall not be liable for delays or failures caused by events beyond its reasonable control.
19.2 Severability: If any provision is held invalid, the remaining provisions shall remain in full force.
19.3 Assignment: You may not assign your rights or obligations without JAGCART’s prior written consent; JAGCART may assign its rights to any successor in interest.
19.4 Entire Agreement: These Terms, together with the Policies, constitute the entire agreement between you and JAGCART concerning the Site.
19.5 No Waiver: Failure to enforce any provision shall not constitute a waiver of that provision.
